3. Acceptance of these terms

You accept these Terms and Conditions when you:

  • access or use our website;
  • submit an enquiry through our website;
  • book an appointment;
  • attend or participate in a service;
  • download or use one of our resources; or
  • otherwise engage with Vida Life Counselling.

Additional terms may apply to a particular service, appointment, workshop, insurer-funded service or professional arrangement.

These additional terms may be provided through:

  • an intake or consent form;
  • an engagement agreement;
  • a booking confirmation;
  • an invoice or quotation;
  • Halaxy;
  • email correspondence;
  • a workshop registration page; or
  • another written communication.

Where additional terms are provided for a particular service, those terms form part of your agreement with Vida Life Counselling.

If there is an inconsistency, the specific written terms applying to the relevant service will take priority to the extent of the inconsistency.

4. Counselling services

Our counselling services are intended to provide professional emotional, psychological and personal support based on your circumstances, needs and agreed goals.

Counselling may involve discussing personal, emotional, relational, behavioural, workplace, health or other sensitive matters.

The counselling process may sometimes feel difficult or uncomfortable. Exploring challenging experiences can temporarily result in increased emotional distress, discomfort or awareness of difficult thoughts and feelings.

Your counsellor will work collaboratively with you, but counselling outcomes differ between individuals.

We do not guarantee:

  • a particular outcome;
  • that symptoms or concerns will be completely resolved;
  • that counselling will improve a particular relationship;
  • that counselling will result in a particular employment, insurance, medical or legal outcome; or
  • that a particular therapeutic approach will be suitable for every person.

You remain responsible for your decisions, actions and participation in the counselling process.

5. No emergency or crisis services

Vida Life Counselling is not an emergency, crisis-response or after-hours service.

Our website contact form, email address, telephone messages and online booking system are not continuously monitored.

If you or another person is in immediate danger, call 0434 973 149 or attend the nearest hospital emergency department.

Do not rely on our website, email, voicemail, text message or booking platform for urgent or emergency assistance.

6. Medical and healthcare disclaimer

Vida Life Counselling provides counselling and related professional support. Information on our website is general information only.

Website content, worksheets, articles, videos, social media content and downloadable resources are not:

  • medical advice;
  • psychiatric advice;
  • psychological diagnosis;
  • legal advice;
  • financial advice;
  • a substitute for individual professional assessment or treatment; or
  • a substitute for emergency assistance.

You should seek advice from an appropriately qualified professional regarding your individual circumstances.

You should not disregard medical or other professional advice, or delay seeking assistance, because of information available on our website.

Where appropriate, your counsellor may recommend that you consult a general practitioner, psychologist, psychiatrist, legal practitioner or another suitably qualified professional.

7. Suitability of services

We may assess whether our services are reasonably appropriate for your needs.

We may decline, postpone, limit, refer or discontinue a service where we reasonably believe that:

  • the service is not suitable for your needs;
  • another type of practitioner or service would be more appropriate;
  • your needs fall outside the practitioner’s professional scope or competence;
  • there is an actual or potential conflict of interest;
  • the therapeutic relationship is no longer effective or appropriate;
  • safety concerns cannot reasonably be managed;
  • you require crisis or emergency support;
  • continuing the service may breach a professional, ethical, insurance or legal obligation;
  • fees remain unpaid;
  • you repeatedly fail to attend appointments;
  • you engage in threatening, abusive, discriminatory or inappropriate conduct; or
  • another reasonable professional or operational ground exists.

Where appropriate and practicable, we may discuss alternative options or provide information about another service.

A referral does not guarantee that another provider will accept you or that their service will be suitable or available.

8. Making a booking

Appointments may be requested:

  • through our Halaxy online booking system;
  • by telephone;
  • by email;
  • through the website contact form; or
  • through a referring practitioner, insurer or authorised organisation.

A submitted booking request does not necessarily mean that an appointment has been confirmed.

An appointment is confirmed when you receive confirmation from Vida Life Counselling or through our booking system.

You are responsible for ensuring that the information supplied during booking is complete and accurate.

You must notify us as soon as reasonably possible if your:

  • contact information changes;
  • appointment details are incorrect;
  • funding or insurance arrangements change;
  • referral or claim details change; or
  • circumstances affect your ability to attend or participate safely.

9. Halaxy and external booking services

Vida Life Counselling uses Halaxy for online bookings and aspects of practice administration.

When you use Halaxy, you may also be subject to Halaxy’s terms, privacy policy and platform requirements.

Halaxy is an external service provider. While we take reasonable care in selecting systems used by our practice, we do not control the availability, functionality or security of Halaxy’s systems.

Vida Life Counselling is not responsible for an outage, delay, error or other issue caused solely by Halaxy or another external service provider, except to the extent that responsibility cannot lawfully be excluded.

If you experience difficulty with an online booking, contact us at admin@vida-life.com.au or 0434 973 149.

10. Appointment fees

The applicable fee for a service will be:

  • displayed on the relevant service or booking page;
  • stated in Halaxy;
  • included in a quotation, invoice or booking confirmation; or
  • otherwise communicated to you before or when the service is arranged.

Fees may vary depending on:

  • the type of service;
  • the practitioner;
  • the length of the session;
  • whether the service is individual, couples or multi-client counselling;
  • whether the service is delivered in person or online;
  • whether an extended session is requested;
  • the funding or insurance arrangement; and
  • any agreed workshop, supervision or professional-development package.

You are responsible for confirming the applicable fee before attending a service.

Unless otherwise stated, you are responsible for paying the full fee for services provided to you.

We may update our fees from time to time. A fee change will not ordinarily affect a service that has already been completed.

11. Payment

Payment is required at the time stated in your booking confirmation, invoice, service agreement or other written communication.

Payment may be processed through:

  • Halaxy;
  • an approved payment provider;
  • electronic funds transfer;
  • an insurer or compensation provider;
  • another agreed payment method.

You authorise us and our payment providers to process amounts that you have agreed to pay.

You are responsible for:

  • providing correct payment details;
  • ensuring sufficient funds are available;
  • paying any amount not covered by an insurer, compensation scheme or third-party funder; and
  • promptly contacting us if you believe an invoice or payment is incorrect.

Overdue amounts may result in future appointments being postponed or cancelled, subject to professional and legal obligations.

We may take reasonable steps to recover unpaid fees. You may be responsible for reasonable recovery costs where permitted by law.

12. Cancellations, rescheduling and missed appointments

Appointments are reserved specifically for you.

If you need to cancel or reschedule, you must provide the amount of notice stated in:

  • your booking confirmation;
  • your intake or consent documents;
  • Halaxy;
  • your service agreement; or
  • another written communication from us.

A cancellation or non-attendance fee may apply where:

  • insufficient notice is provided;
  • you do not attend an appointment;
  • you join an online appointment too late for the session to proceed; or
  • the appointment cannot proceed because you have not completed a required step.

Any cancellation fee and required notice period will be communicated through the applicable booking or service terms.

A third-party funder, insurer, WorkCover Queensland or CTP insurer may not pay cancellation or non-attendance fees. Where this occurs, you may be personally responsible for the fee if this was disclosed in the applicable booking or service terms.

We may waive a cancellation fee at our discretion in exceptional circumstances. A previous waiver does not require us to waive a future fee.

13. Changes or cancellations by Vida Life Counselling

We may need to reschedule, modify or cancel an appointment because of:

  • practitioner illness;
  • emergencies;
  • safety concerns;
  • technical difficulties;
  • events outside our reasonable control;
  • professional or ethical requirements; or
  • other operational circumstances.

We will take reasonable steps to notify you and offer an alternative appointment where appropriate.

To the extent permitted by law, we are not responsible for indirect costs or losses arising from an appointment being rescheduled or cancelled, such as travel costs, lost income or other personal arrangements.

If you prepaid for a service that we cancel and cannot reasonably reschedule, we will provide an appropriate refund or credit.

14. Late arrival

If you arrive late, your appointment may still finish at the originally scheduled time so that the next client is not affected.

The full appointment fee may remain payable.

If you arrive so late that the service cannot reasonably or safely proceed, the appointment may be treated as a missed or late-cancelled appointment under the applicable cancellation terms.

15. Online and telehealth sessions

Where available, counselling or other services may be delivered through telephone or video conferencing.

You are responsible for:

  • using a reasonably secure device and internet connection;
  • attending from a private and appropriate location;
  • ensuring other people cannot overhear the session unless their participation has been agreed;
  • ensuring your device is charged and functioning;
  • providing accurate contact and location information where reasonably requested; and
  • not driving or operating machinery during a session.

Online services can be affected by:

  • internet disruption;
  • device failure;
  • platform outages;
  • reduced privacy;
  • unauthorised access;
  • difficulty assessing non-verbal communication; or
  • difficulty responding to an emergency remotely.

If the connection fails, your counsellor may attempt to contact you using the contact details you provided.

We may decide that an online service is not appropriate where privacy, safety, clinical or technical concerns cannot reasonably be addressed.

You must not record an online or in-person session without the prior express agreement of every participant and Vida Life Counselling.

16. Client responsibilities

When using our services, you agree to:

  • provide information that is accurate and complete to the best of your knowledge;
  • participate honestly and respectfully;
  • tell your counsellor about information relevant to your safety or care;
  • advise us of changes affecting your appointments, funding or treatment;
  • attend appointments in an appropriate condition to participate;
  • avoid threatening, abusive, harassing or discriminatory conduct;
  • respect the privacy and dignity of practitioners, staff and other clients;
  • comply with reasonable safety, health and site directions;
  • pay applicable fees; and
  • comply with these Terms and Conditions and any specific service agreement.

We may take appropriate action if these responsibilities are not met, including ending a session, restricting contact, requiring another communication arrangement or discontinuing services.

17. Children and young people

Services for a child or young person may require the consent of a parent, guardian or another person with lawful authority.

Before providing a service, we may request information regarding:

  • parental responsibility;
  • guardianship;
  • consent;
  • court orders;
  • parenting arrangements;
  • the young person’s capacity to consent; and
  • other relevant legal or clinical circumstances.

You must provide accurate information and disclose any relevant court order, parenting dispute or restriction affecting consent, attendance, communication or access to records.

Where appropriate, we will explain how privacy and confidentiality apply to the child or young person and to their parent or guardian.

We may decline or pause services where consent or authority is unclear or disputed.

18. Couples, family and multi-client services

Where a service involves more than one client:

  • each participant must behave respectfully;
  • the counsellor does not act as an advocate for one participant against another;
  • the counsellor may establish additional rules about individual communications and confidentiality;
  • information provided separately may be managed according to the arrangements explained by the counsellor;
  • the service may be discontinued if safety, coercion, conflict or another concern makes it inappropriate to continue; and
  • one participant must not assume that they control the records or decisions of another participant.

Vida Life Counselling cannot guarantee that another participant will maintain the confidentiality of information discussed during a joint session.

Couples counselling is not legal representation, mediation or evidence preparation for court proceedings unless expressly agreed in writing.

19. Confidentiality and its limits

Counselling information is treated as confidential and handled in accordance with our Privacy Policy and applicable law.

Confidentiality is not absolute.

Information may be used or disclosed where:

  • you provide consent;
  • disclosure is required or authorised by law;
  • a court or tribunal requires records;
  • a mandatory reporting obligation applies;
  • there is a serious threat to a person’s life, health or safety;
  • disclosure is reasonably necessary to lessen or prevent that threat;
  • disclosure is required to manage an emergency;
  • information is reasonably required for confidential professional supervision;
  • information is required to manage a WorkCover, CTP, insurance or authorised referral arrangement;
  • disclosure is reasonably necessary for a legal or insurance claim; or
  • another lawful exception applies.

Further information is contained in our Privacy Policy.

20. WorkCover Queensland services

WorkCover counselling is available subject to applicable eligibility, approval and claim requirements.

You may be required to provide:

  • an accepted WorkCover claim number;
  • referral or approval information;
  • employer or insurer details;
  • claim-manager information; and
  • other documents reasonably required to provide or invoice for the service.

Vida Life Counselling does not control:

  • whether a claim is accepted;
  • the number of sessions approved;
  • whether a particular fee is covered;
  • whether further treatment is approved;
  • decisions made by WorkCover Queensland, an employer or another claim participant; or
  • the outcome of a claim.

If funding is declined, withdrawn, exhausted or delayed, you may be responsible for fees where this has been disclosed and agreed.

We may provide reports, invoices, attendance information and relevant clinical information where authorised or required under the claim arrangements or by law.

21. CTP counselling services

CTP counselling may require:

  • a valid CTP claim number;
  • approval from the relevant insurer;
  • a referral or letter from a doctor;
  • insurer or case-manager details; and
  • other documents reasonably required to provide the service.

Vida Life Counselling does not guarantee that:

  • an insurer will approve counselling;
  • all requested sessions will be funded;
  • an insurer will pay a particular fee;
  • a claim will succeed; or
  • counselling will produce a particular legal, insurance or recovery outcome.

If funding is declined, withdrawn, exhausted or delayed, you may be responsible for fees where this has been disclosed and agreed.

With your consent or where otherwise authorised, we may communicate with health practitioners, insurers, lawyers, rehabilitation providers and other parties involved in your recovery.

22. Private health insurance

Private health insurance rebates may be available for some services, practitioners or funds.

Eligibility and rebate amounts depend on:

  • your insurer;
  • your policy;
  • your level of cover;
  • the practitioner;
  • the service provided; and
  • your insurer’s rules.

You are responsible for checking your eligibility directly with your insurer before attending.

Vida Life Counselling does not guarantee that a private health insurer will provide a rebate.

Vida Life Counselling does not provide Medicare rebates unless expressly stated otherwise.

You remain responsible for the full service fee regardless of whether you receive a rebate.

23. Reports, letters and third-party requests

A request for a letter, report, form, file review, case conference, telephone consultation or communication with another professional may involve an additional fee.

Before preparing a document, we may require:

  • your written consent;
  • clarification about its purpose;
  • details of the intended recipient;
  • advance payment;
  • additional time;
  • an appointment; or
  • further information.

We are not required to prepare a report or express an opinion that:

  • falls outside the practitioner’s expertise;
  • is inconsistent with the clinical record;
  • is misleading or unsupported;
  • creates a conflict of interest;
  • is requested for an inappropriate purpose; or
  • would breach a professional, ethical or legal duty.

We do not guarantee that a report or letter will produce a particular legal, insurance, employment or administrative outcome.

24. Court proceedings and subpoenas

Counselling services are not provided for the primary purpose of creating evidence for legal proceedings unless this is expressly agreed in writing.

If Vida Life Counselling or a practitioner receives a subpoena, summons, court order or another legally enforceable request, we may be required to produce records or attend court.

Where permitted, reasonable fees may apply for:

  • reviewing records;
  • preparing documents;
  • responding to legal correspondence;
  • attending court;
  • travel;
  • waiting time; and
  • obtaining legal advice.

You must not represent that a counsellor has agreed to attend court or provide an expert opinion unless that agreement has been confirmed in writing.

25. Professional supervision, workshops and training

Professional supervision, workshops and training are educational and professional-development services.

Unless expressly stated otherwise:

  • they do not create a counsellor-client relationship;
  • they are not a substitute for personal therapy;
  • they do not guarantee professional accreditation, registration, employment, promotion or a particular client outcome;
  • CPD recognition depends on the requirements of the participant’s professional body or employer; and
  • participants are responsible for determining whether a service meets their professional obligations.

Workshop and training materials are provided for educational purposes and may not address every workplace, client or legal circumstance.

Fees, attendance requirements, cancellation arrangements and inclusions may be set out in a quotation, proposal, registration page or service agreement.

26. Website resources and downloadable materials

Our website may provide free or paid worksheets, handouts, articles, videos, guides and other materials.

These resources are provided for general educational purposes only.

They are not intended to:

  • diagnose a condition;
  • provide personalised treatment;
  • replace counselling or healthcare;
  • manage an emergency;
  • create a professional-client relationship; or
  • guarantee a particular result.

You are responsible for deciding whether a resource is suitable for your circumstances.

Stop using a resource and seek appropriate professional assistance if it causes significant distress or is not suitable for your needs.

27. Intellectual property

Unless otherwise stated, Vida Life Counselling owns or is licensed to use the intellectual property on its website and in its materials, including:

  • photographs;
  • videos;
  • training content;
  • workshop slides;
  • downloads; and
  • website design.

You may access website materials for personal, non-commercial use.

You must not, without prior written permission:

  • reproduce or republish our materials;
  • sell, license or commercially distribute them;
  • modify them and present them as your own;
  • remove copyright or attribution notices;
  • upload them to another website, course or platform;
  • use them to train or provide services to others;
  • include them in paid products or services; or
  • use our branding in a way that suggests endorsement or affiliation.

You may print or download a reasonable number of copies of freely available resources for your own personal use.

Any additional permission must be obtained in writing.

  • unlawfully or fraudulently;
  • to threaten, harass or harm another person;
  • to transmit malicious software;
  • to attempt unauthorised access to our systems;
  • to interfere with the website’s operation or security;
  • to collect information about other users without authority;
  • to impersonate another person;
  • to submit false or misleading information;
  • to infringe intellectual property or privacy rights; or
  • in a way that places an unreasonable burden on our systems.

We may restrict or block access where we reasonably believe the website is being misused.

  • YouTube;
  • insurers;
  • professional organisations;
  • referral partners;

  • other third-party services.

Third-party services are not controlled by Vida Life Counselling.

A link does not mean that we endorse every statement, service or practice of the third party.

You access third-party websites and services at your own discretion and subject to their terms and privacy policies.

To the extent permitted by law, we are not responsible for loss arising solely from your use of a third-party website or service.

30. Website availability and accuracy

We take reasonable care to maintain our website and provide useful information.

However, we do not guarantee that:

  • the website will always be available;
  • access will be uninterrupted or error-free;
  • every error will be corrected immediately;
  • the website will be free from viruses or harmful components;

  • every service displayed will be available at all times.

Services, practitioners, fees, opening hours and website content may change.

You should contact us to confirm information that is important to your decision to book or use a service.

31. Privacy

We collect, hold, use and disclose personal and health information in accordance with our Privacy Policy and applicable law.

Our Privacy Policy is available at:

By providing information to us, you acknowledge that you have reviewed or had the opportunity to review our Privacy Policy.

These Terms and Conditions should be read together with the Privacy Policy and any applicable consent or service documents.

32. Consumer guarantees

Nothing in these Terms and Conditions excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

Where a service is supplied to a consumer, statutory consumer guarantees may apply.

If a service fails to meet an applicable consumer guarantee, you may be entitled to a remedy under Australian law.

33. Limitation of liability

To the maximum extent permitted by law, Vida Life Counselling is not liable for:

  • indirect or consequential loss;
  • loss arising from reliance on general website information;
  • decisions made without seeking appropriate individual professional advice;
  • interruptions caused by external technology or communication providers;
  • the acts or omissions of independent third parties;
  • an insurer’s, employer’s, funder’s or government agency’s decision;
  • another participant’s disclosure of information from a couples or group service; or
  • loss caused by information you provide being inaccurate, incomplete or withheld.

Where liability cannot lawfully be excluded but can be limited, our liability will be limited to the extent permitted by law.

Nothing in this section limits liability for fraud, wilful misconduct, professional negligence or another liability that cannot lawfully be excluded or limited.

34. Indemnity

To the extent permitted by law, you agree to compensate Vida Life Counselling for reasonable loss, damage, liability or expense arising directly from:

  • your unlawful use of the website;
  • your material breach of these Terms and Conditions;
  • your infringement of another person’s rights;
  • false or misleading information knowingly provided by you; or
  • your unauthorised reproduction or commercial use of our intellectual property.

This section does not require you to compensate us to the extent that the loss was caused or contributed to by Vida Life Counselling’s negligence, unlawful conduct or breach of duty.

  • our website changes;
  • our booking or payment systems change;
  • legal or regulatory requirements change; or
  • our business practices change.

The current version will be published on our website and identified by its “Last updated” date.
